Terms of Service

Welcome to JobWiz. These Terms of Service ("Terms") constitute a legally binding agreement between you and JobWiz ("we," "us," or "our") regarding your use of our resume editing platform, job application tracking system, and related services (collectively, the "Service").

By accessing or using JobWiz, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Important: JobWiz is currently in beta and accessible by invitation only. Additional terms specific to the beta program are outlined in Section 4 below.

JobWiz provides the following services during our beta phase:

2.1 Resume Editor

• Web-based resume creation and editing tools
• PDF import and export functionality
• Real-time preview and formatting
• Multiple resume versions and templates
• Cloud storage for resume data

2.2 AI-Powered Optimization

• AI-generated resume suggestions and improvements
• Job-specific resume tailoring recommendations
• Keyword optimization for ATS (Applicant Tracking Systems)
• Content enhancement suggestions

2.3 Job Application Tracking

• Application status tracking and management
• Job posting organization and notes
• Follow-up reminders and notifications
• Application timeline and history

2.4 Browser Extension (Beta)

• Auto-fill functionality for job applications
• Quick access to resume data while browsing
• One-click job posting saves

Beta Limitation: Features and functionality may change significantly during the beta period. Some features may be incomplete, experimental, or subject to modification or removal without notice.

3.1 Account Creation

To use JobWiz, you must:

• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Have received a valid beta invitation code
• Maintain the security and confidentiality of your password
• Accept responsibility for all activities under your account

3.2 Account Security

You agree to:

• Use a strong, unique password for your account
• Not share your account credentials with others
• Immediately notify us of any unauthorized access or security breach
• Log out from shared or public devices
• Keep your contact information up to date

3.3 Prohibited Uses

You may not:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload false, misleading, or fraudulent information
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated tools (bots, scrapers) without permission
• Reverse engineer, decompile, or attempt to extract source code
• Resell, redistribute, or commercially exploit the Service
• Upload viruses, malware, or other harmful code
• Harass, abuse, or harm other users

3.4 Content Responsibility

You are solely responsible for:

• The accuracy and legality of content you upload (resumes, job data)
• Ensuring you have the right to share any information you provide
• Maintaining backups of your important data
• Compliance with employment laws and anti-discrimination regulations

4.1 Invitation-Only Access

• Beta access is granted by invitation only and may be revoked at any time
• Invitations are non-transferable and may not be shared or sold
• We reserve the right to limit the number of beta participants
• Beta access does not guarantee continued access after beta ends

4.2 Beta Software Limitations

You acknowledge and agree that the Service in its beta form:

• May contain bugs, errors, or defects
• May experience downtime, data loss, or service interruptions
• May have incomplete or experimental features
• Is provided "as is" without warranties of any kind
• May undergo significant changes without notice

4.3 Beta Feedback

• We encourage you to provide feedback, bug reports, and suggestions
• Any feedback you provide becomes our property and may be used freely
• You will not be compensated for feedback or suggestions
• Critical bugs or security issues should be reported immediately to support@jobwiz.biz

4.4 No Service Level Guarantees

During the beta period:

• We do not guarantee any specific uptime or availability
• Service may be interrupted for maintenance without notice
• We may reset, modify, or delete data for testing purposes
• No compensation will be provided for service disruptions

4.5 Confidentiality

• Beta features and functionality are confidential
• Do not publicly share screenshots, videos, or detailed descriptions without permission
• You may mention you are a beta tester but should not disclose non-public features
• This confidentiality requirement expires upon public launch

5.1 JobWiz Intellectual Property

All rights, title, and interest in the Service, including but not limited to:

• Software code, algorithms, and architecture
• User interface designs and layouts
• Logos, trademarks, and brand elements
• Documentation and help materials
• AI models and training data

...are owned exclusively by JobWiz and are protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content

You retain ownership of content you upload, including:

• Resume data and work history
• Job application notes and tracking data
• Personal information and preferences

However, you grant us a limited license to use this content to provide the Service, including:

• Storing and processing your data
• Generating AI suggestions and optimizations
• Displaying your content back to you
• Creating backups and ensuring data redundancy

5.3 License Scope

The license you grant us is:

• Limited: Only for operating the Service
• Non-exclusive: You can use your content elsewhere
• Revocable: Ends when you delete your account
• Worldwide: To serve global infrastructure

5.4 AI Training and Aggregated Data

• We may use anonymized, aggregated data to improve AI features
• Individual resumes will not be used to train AI without explicit consent
• Usage patterns may be analyzed to enhance the Service
• You can opt out of AI feature improvements in your settings

6.1 Beta Pricing

Free During Beta: JobWiz is currently free for all beta participants. No payment is required during the beta period.

6.2 Future Pricing

• JobWiz may introduce paid plans after the beta period ends
• Beta participants will receive advance notice of pricing changes
• We may offer special pricing or features to early beta users
• You will have the option to continue with a free tier or upgrade

6.3 No Guarantee of Free Service

Participation in the beta program does not guarantee:

• Lifetime free access
• Grandfathered pricing
• Access to all future features at no cost

7.1 Your Responsibility

Important: You are responsible for maintaining backups of your important data. While we implement redundancy and backup systems, beta software may experience data loss.

7.2 Export Options

You can export your data at any time:

• Resume data in PDF, JSON, or DOCX format
• Job application history and notes
• Account settings and preferences

7.3 Data Portability

We support data portability in compliance with GDPR and CCPA. You can request a complete copy of your data at any time.

8.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or availability
• Warranties that the Service will be uninterrupted or error-free
• Warranties that defects will be corrected

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBWIZ SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or use of our servers
• Damages resulting from interruption or cessation of the Service
• Damages resulting from bugs, errors, or defects in beta software
• Damages resulting from reliance on AI-generated suggestions

8.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED $100 (ONE HUNDRED US DOLLARS).

8.4 Basis of the Bargain

You acknowledge that these limitations of liability are fundamental elements of the agreement between you and JobWiz, and that we would not provide the Service without these limitations.

8.5 AI Suggestions Disclaimer

AI-generated resume suggestions are for informational purposes only. You are responsible for:

• Reviewing and verifying all AI suggestions before use
• Ensuring accuracy and truthfulness of your final resume
• Compliance with employer requirements and application standards
• Not relying solely on AI suggestions for job applications

You agree to indemnify, defend, and hold harmless JobWiz, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or submit to the Service
• False or misleading information in your resume or applications

10.1 Termination by You

• You may terminate your account at any time from account settings
• Upon termination, your access to the Service will cease immediately
• We recommend exporting your data before deleting your account

10.2 Termination by JobWiz

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse or misuse the Service
• We discontinue the beta program
• Required by law or legal process

10.3 Beta Program Termination

• The beta program may end at any time without advance notice
• We will provide reasonable notice before shutting down the Service
• You will have the opportunity to export your data before shutdown
• No refunds or compensation will be provided (service is free)

10.4 Effect of Termination

Upon termination:

• Your license to use the Service terminates immediately
• Your data will be deleted according to our Privacy Policy
• Sections of these Terms that should survive will remain in effect

We reserve the right to modify these Terms at any time. Changes will be communicated as follows:

11.1 Notice of Changes

• Material Changes: Email notification at least 30 days before effective date
• Minor Changes: Updated "Last updated" date at top of page
• Beta Changes: May occur more frequently with shorter notice

11.2 Your Options

If you disagree with updated Terms:

• You may terminate your account before the changes take effect
• Continued use of the Service constitutes acceptance of new Terms
• You can export your data before terminating

12.1 Informal Resolution

Before filing a legal claim, you agree to contact us at support@jobwiz.biz to attempt to resolve the dispute informally.

12.2 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration, except for:

• Claims in small claims court
• Intellectual property disputes
• Claims of violation of these Terms

12.3 Class Action Waiver

You agree that disputes will be resolved individually, not as part of a class action or collective action.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobWiz regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, or failures of third-party services.
